Bray Tutoring – Terms and Conditions
1. Definitions and Interpretation
In these terms and conditions, as amended from time to time (these “Terms”) the following words and phrases shall have the meanings set out opposite them unless otherwise clearly stated to the contrary and the singular shall include the plural and vice versa:
1:1 Tutoring: | Tutoring provided on the basis of a Tutor proving Tuition to a Tutee. |
Bray Tutoring: | A business owned and operated by Julia Crocker, trading as Bray Tutoring. |
Group Courses: | Any course of Tuition where a minimum of 3 Tutees sign up and pay to receive Tuition together (at the same times) from a single Tutor. |
Tuition: | Any service supplied by a Tutor pursuant to these Terms and “Tutoring” shall be interpreted accordingly. |
Tuition Fee: | The amount(s) charged for Tuition, details of which (as updated from time to time) are available on the Website. |
Tutee/ You: | Each person who signs up with Bray Tutoring to receive Tuition. |
Tutor: | Any representative of Bray Tutoring offering Tuition pursuant to these Terms. |
Us/We/Our: | Bray Tutoring. |

2. Terms and Conditions and Our Policies
2.1 If You contact Us to request Tuition then you agree to abide by, and that the provision of any Tuition will be governed by, these Terms.
2.2 You must, prior to receiving any Tuition, read Our policies in relation to safeguarding and privacy – both of which are available on the Website. You will, by attending to receive any Tuition, be deemed to have understood and agreed to those policies.
3. Fees and Payment
3.1 All Tuition Fees are payable in advance.
3.2 Apart from in respect of any initial, trial sessions for 1:1 Tutoring, all Tuition sessions (including for Group Courses) must be booked and paid for in 4 weekly blocks. In the event that fewer than 3 Tutees have signed up to attend a Group Course in advance, We will notify the Tutees who have paid that We do not have sufficient Tutees to be able to run a Group Course and they will either have to change to 1:1 Tutoring or alternative dates for a Group Course will have to be discussed (again subject to there being at least 3 Tutees who sign up to attend those later dates).
3.3 Bray Tutoring will invoice You for the Tuition Fees due and a due date for payment therefor.
3.4 Payment of Tuition Fees in accordance with Clause 3.3 (above) will be deemed to constitute confirmation that the relevant sessions are booked but, for the avoidance of doubt, if any payments invoiced for pursuant to Clause 3.3 are not paid for by the stated due date then the Tuition sessions will not proceed.
4. Cancellation and Timings
Cancellations by the Client:
4.1 Bray Tutoring sessions are non-refundable once payment has been made.
4.2 If You are unable to attend a 1:1 Tutoring session and sufficient notice (being not less than 24 hours) is given in writing, the Tutor will endeavour to reschedule the session at a mutually convenient time, but this cannot be guaranteed and, if no rescheduling is possible within two weeks of the original date, the Tutor shall be under no obligation to try to reschedule the session.
4.3 Due to the nature of Group Courses, once they have been paid for and have been scheduled, they will go ahead even if one or more Tutees cannot attend, provided that at least 3 Tutees are able to attend. If any Tutee(s) who have signed up for a Group Course is/ are unable to attend a Group Course session then, provided they have given at least 24 hours’ notice in writing and there are only 1 or 2 remaining Tutees who can attend the original session, the Tutor will endeavour to reschedule the session at a time which at least 3 Tutees and the Tutor can make, but this cannot be guaranteed and, if no rescheduling is possible within two weeks of the original date, the Tutor shall be under no obligation to try to reschedule the Group Course session.
If any Tutee(s) who have signed up for a Group Course is/ are unable to attend a Group Course session but there are at least 3 Tutees who can still attend that session, the session will proceed as scheduled with the Tutee(s) who is/ are unable to attend missing the session and not being eligible to receive any form of refund as a result.
Cancellations due to unforeseen circumstances:
4.4 If sessions cannot go ahead due to unforeseen circumstances beyond our reasonable control and need to be cancelled by Bray Tutoring, then You will be refunded fully – subject only to deduction of any costs which We have incurred and in relation to which we would otherwise be out of pocket.
5. Termination
5.1 Tuition Sessions will continue until either a mutually agreed termination date or in the event that You fail to pay for any sessions in accordance with Clause 3 of these Terms.
5.2 As set out in Clause 3.2 of these Terms, payment for Tuition sessions is generally required in 4 weekly blocks in advance. If You wish to terminate Tuition during any such block, refunds cannot be given for the remaining Tuition sessions.
6. Limitation of Liability
6.1 Bray Tutoring shall not be liable for any loss, expense, damage, delay, costs or compensation which may be incurred by You as a result of or arising (directly or indirectly) from the Tuition, other than where (and to the extent) it is otherwise prescribed by law.
6.2 Whilst We work hard to support and extend the learning of all Tutees, this cannot be guaranteed and We are not responsible for any Tutees’ lack of progress, exam failure and/ or negative school report grades.
7. Jurisdiction, entire agreement and governing law:
7.1 These Terms and the resulting agreement are governed by the laws of England and Wales and We and You submit to the exclusive jurisdiction of the Courts of England and Wales in the case of any dispute (contractual or non-contractual).
7.2 These Terms constitute the whole agreement between Us and You and no variation or alteration of these Terms shall be valid unless approved in writing by Julia Crocker.
7.3 We reserve the right to alter these Terms from time to time and will notify You in writing in the event of any changes.
